Divorce Misery Due To Spiralling Costs

A report just published by the Legal Ombudsman suggests that ‘spiralling costs and poor quality legal services are adding to the misery of divorce’ according to the BBC.The divorce process can be one of the most demanding that a couple will go through, and most people use a solicitor to help them through its complexities. Choosing the right solicitor is key to ensuring you receive good quality legal services, and transparent pricing is equally important.

James Haworth, Family Law Partner at Lawson-West explains how the cost of divorce can rise in various circumstances:

“If a couple argue during divorce proceedings, the old adage of ‘time is money’ comes into play.  The longer it takes them to come to a resolution, the higher the cost of the proceedings as their solicitor becomes more and more involved in sorting things out.

Another delay is caused when one party tries to hide assets, or is otherwise uncooperative; it can take even longer to get a true picture of finances in order to reach a settlement.

We also come across situations where one or other party uses the divorce proceedings to hurt the other, perhaps by throwing accusations which it takes the court a long time to prove or disprove. This form of dragged out divorce again will cost more than an original estimate as the solicitor cannot predict the outcome from the start.

The best advice for those wishing to get through a divorce as quickly and cost-effectively as possible is to try to reach an agreement out of court, and as amicably as possible. This allows the solicitor to expedite the divorce, keeping both cost and aggravation to a minimum.”
