New Gas Safety Scheme from 1 April 2009

Landlords of domestic properties will already be aware of their
statutory obligations to comply with the Gas Safety Regulations 1998
designed to protect tenants from unsafe gas appliances. These
* A duty to keep gas appliances and
* A duty to ensure that gas
appliances are checked every 12 months and to keep detailed records of
those checks; and
* A duty to ensure that the
checks are made by a CORGI registered engineer.
From 1 April 2009, the CORGI registration scheme will be replaced with
a new gas safety scheme called the “Gas Safe Register”. It
will be the official industry stamp for gas safety, which will be
maintained and enforced by the Health and Safety Executive.
Residential landlords should check that anyone carrying out work on gas
appliances or flues is registered under the new Gas Safe
Register. CORGI registration will no longer carry any
In the commercial sector, landlords and employers should check that any
installer of gas appliances or flues is registered under the Gas Safe
There has been little publicity about the Gas Safe Register so
landlords and managing agents may be surprised to learn about the
changes. There is no grace period so landlords and managing
agents are urged to act now before 1 April 2009. Those with
long term contracts to carry out gas safety inspections and maintenance
should check now that their contractor is registered or registering
under the new scheme and to ensure, from 1 April 2009, that they keep
records of the engineer’s new registration.
